Code of Alabama Section 32-8-30, 32-8-35 and 32-8-39.

If the owner’s current legal name, as recorded on the certificate of title has changed, the owner shall make application for a corrected certificate of title to record the current legal name of the owner prior to the renewal of the registration for the motor vehicle. Each application for first certificate of title of a vehicle in this state shall contain the current legal name of the owner and each certificate of title issued by the department shall contain the current legal name of the owner.


The Alabama Department Of Revenue, Motor Vehicle Division, Title Section Will Accept Title Applications With The Following Documentation For Name Corrections:

  • Current Alabama Certificate Of Title
  • Copy Of Evidence Of Identity

The Department Will Also Accept Applications With The Following Documentation For Name Corrections Due To Marriage, Divorce, Etc:

  • Copy Of Marriage Certificate
  • Copy Of Divorce Decree Granting Name Change
  • Other Legal Documentation Granting Name Change(S) For Other Reasons

Rule 810-5-.09 Title Procedure – Transfer Of Title For A Vehicle From
A Deceased Owner

When the estate has not been and will not be probated; the next of kin shall transfer ownership of the vehicle.  The following procedures must be followed:

  • The next of kin shall complete MVT 5-6 “Affidavit for Assignment of Title From A Deceased Owner Whose Estate does not require probate”. By completing the form, the next of kin attests that he/she is the next of kin and it is the desire of all said heirs that either an application for replacement title or transfer of title be executed.  This form must be notarized.
  • Copy of death certificate is required.

If the next of kin is selling the vehicle, he/she is not required to transfer title into their name.  The next of kin will sign the reverse side of the title as the “seller” and provide the “buyer” with the Title, Affidavit of Deceased Owner, copy of Death Certificate and Bill of Sale.

Rule 810-5-.09 Title Procedure – Transfer Of Title For A Vehicle From
A Deceased Owner

When the Estate has been or will be Probated, the court will appoint an Administrator. The Administrator shall transfer ownership of the vehicle. The following procedures must be followed:

  • The Administrator of the estate will sign the reverse side of the title as the “seller”.  This is being done on behalf of the estate of the deceased owner. 
  • Copy of Letter of Testamentary issued by the court.

If the Administrator is selling the vehicle, he/she is not required to transfer title into their name.  The Administrator will sign the reverse side of the title as the “seller” and provide the “buyer” with the Title, Letter of Testamentary and Bill of Sale.

Rule 810-5-.09 Title Procedure – Transfer Of Title For A Vehicle From
A Deceased Owner

When the Deceased Individual Acquired Vehicle but did not Title Prior to Death

In the event that an individual acquires a vehicle, but did not title the vehicle before his/her death, the vehicle must be titled in the estate of the deceased owner.

An application for certificate of title, accompanied by the required supporting documents which reflect two (2) owners, shall have the names of both owners on the application.  If the owners names are joined with “and” or with no conjunction between the names both owners are required to sign the title application. Two (2) owners whose names are joined by the conjunction “or” or “and/or” only one owners signature is required on the title application.

An assignment of title which reflects two (2) owners joined by the conjunction “and” or with no conjunction between the names both owners shall be required to sign the title assignment (reverse side of the title, sign as the “buyer”).  Two (2) owners joined by the conjunction “or” or “and/or” only one owners signature is required on the title assignment (reverse side of the title, sign as the “buyer”).
